Railroad worker sues over fall sustained while spraying weeds

A Madison County railroad company employee says he was hurt on the job when he fell while spraying for weeds.

Harley Robinson filed a lawsuit May 21 in Madison County Circuit Court against BNSF Railway Company.

Robinson says he was working in the telecommunications department for BNSF in June 2009. During that time Robinson says he was asked to spray weeds on the company's property in Oskaloosa, Iowa. Robinson claims while he was spraying he tripped over old cement footings and fell backward. He alleges BNSF is responsible for removing those old cement fixtures and thus liable for his injuries.

BNSF is accused of violating the Federal Employers' Liability Act for allegedly failing to remove the concrete footings or warn of their existence. Robinson asks for more than $50,000 in damages for medical bills, loss of income and court fees.

He is represented by attorney Mark P. Dupont of Dupo.
