Hylla sets trial date in woman's case against Christway Church in Godfrey

Glisson

Madison County Circuit Judge David Hylla on May 25 set a March 4, 2013 trial date in a woman's case against Christway Church and First Baptist Church of Godfrey.

Carol Carpenter claims her son was escorting her from church following Sunday services at Christway Church when they slipped on ice hidden beneath a layer of snow.

Because of the alleged incident on Dec. 27, 2009, Carpenter sustained permanent injuries to her left ankle and left shoulder, requiring three surgeries, according to the complaint filed Dec. 30, 2010 in Madison County Circuit Court.

In addition, she suffered physical pain, mental anguish, incurred medical costs and was unable to perform normal activities, the suit states.

Christway Church and First Baptist Church of Godfrey allegedly negligently designed its parking lot, failed to use proper drainage for its parking lot, failed to remove snow and ice from its parking lot, failed to place salt in areas of unnatural accumulation and removed snow in a way it would accumulate unnaturally in areas of the parking lot and freeze, the complaint states.

Carpenter is seeking a judgment of more than $50,000.

She is represented by Michael P. Glisson of Williamson, Webster, Falb & Glisson in Alton.

Kim Roger Luther and Andrew Luther of Luther & Associates in St. Louis represent First Baptist Church of Godfrey.

Madison County Circuit Court case number: 10-L-1290.
