Father sues Roxana JHS claiming row of gym lockers fell on boy's legs

The father of a minor East Alton boy has filed suit against the junior high school in which a row of 10 lockers fell on his son's legs.

Evyn Davies was a student at defendant Roxana Junior High School on May 16, 2011, and was preparing to dress for his physical education class. When Evyn Davies was attempting to open his locker, a block of 10 lockers fell on his legs, according to the complaint filed May 15 in Madison County Circuit Court.

Because of the incident, Evyn Davies sustained a fracture to his leg and incurred medical costs, the suit states.

Jason Davies, the father of Evyn Davies, blames Roxana Junior High School and Roxana Community School District No. 1 for causing the injuries to his son, saying they negligently failed to ensure the row of lockers was secured to the wall. They also negligently failed to maintain the boys' locker room in a safe condition, failed to inspect the lockers, allowed the lockers to remain in use in the boys room, failed to warn of the unstable condition of the lockers and required students to use locker that were not suitable for their purpose, the complaint says.

In his four-count complaint, Jason Davies is seeking a judgment of more than $50,000, plus costs.

Lanny Darr of Schrempf, Kelly, Napp and Darr in Alton will be representing him.
