The mother of a minor boy has filed suit against the boy's father, saying he accidentally ran over his son while taking him to work at his construction site.
Melissa Hosto claims her son, Adam Hosto, accompanied his father, Richard Hosto, to work on Niemeyer Farm in Edwardsville on July 24, 2008. Adam Hosto was watching his father operate a Bobcat trailer to grade an area at the farm when the incident occurred, according to the complaint filed May 15 in Madison County Circuit Court.
"Richard Hosto made three passes on the Bobcat; on the fourth pass, he backed over his son's right leg and pelvis which caused an open fracture of the tibia and fibula, pelvic fracture and saratoma," the suit states. "Adam underwent 15 surgeries to treat his injuries and has incurred medical bills exceeding $460,000."
In addition to his injuries and medical costs, Adam Hosto sustained permanent disability in his right leg, the complaint says.
In her complaint, Melissa Hosto blames Richard Hosto for causing their son's injuries, saying he negligently failed to keep a proper lookout, drove in reverse without first locating Adam Hosto, failed to instruct his son to stand clear of the Bobcat and failed to equip the Bobcat with side mirrors so he could determine whether someone was standing behind the machine.
In her complaint, Melissa Hosto is seeking costs and other relief the court deems just.
She will be represented by Robert D. Rowland of Goldenberg, Heller, Antognoli and Rowland in Edwardsville.
