Wild Duck Saloon sued over customer's head injuries

An Alton saloon is accused of causing an assault by allegedly allowing someone to get drunk there.

Thomas Garrett filed the lawsuit against Wild Duck Saloon Inc. on April 12 in Madison County Circuit Court.

The alleged incident happened on Oct. 9, 2011 at the Wild Duck Saloon in Alton, according to the complaint. Garrett says he was inside the bar when he was assaulted by an "alleged intoxicated person." During the altercation, he says he received serious injuries to his head that caused bleeding in his brain.

Garrrett contends Wild Duck Saloon violated the Dramshop Act by serving his alleged assailant to the point of intoxication. He also accuses the bar of negligence for the same reason. Garrett is asking for more than $100,000 in damages for pain and suffering, medical expenses and disability.
