Car crash victim sues State Farm alleging it underpaid claim

A St. Clair County woman says her insurance company has refused to pay for a claim after she was involved in a crash.

Dawn Rouggly filed a lawsuit March 29 in St. Clair County Circuit Court against State Farm Mutual Automobile Insurance Company.

Rouggly says she was in a car crash in Monroe County in May 2007. She contends she was current on her insurance premiums, which included underinsured motorist coverage up to $50,000. The other driver settled for $25,000. However, Rouggly says State Farm has only paid out $5,000 for her injuries and expenses despite her damages allegedly exceeding that amount.

State Farm is accused of violating Illinois' Insurance Code for failing to settle Rouggly's insurance claim. Rouggly asks for more than $50,000 in damages and court costs.

She is represented by attorneys Mark C. Scoggins and Anthony P. Gilbreth of Columbia.
