A woman has filed suit against Wendy's, alleging she sustained injuries after she tripped and fell over a high curb at the restaurant.
Daisy E. Crunk alleges she was visiting the Wendy's at 2600 Green Mount Commons Dr. in Belleville on March 5, 2010, when the incident took place.
Because of her fall, Crunk became sick, sore, lame, disordered and disabled; incurred medical costs; and endured surgery on her right wrist, according to the complaint filed March 2 in St. Clair County Circuit Court. In addition, she experienced pain and suffering, lost wages, lost her earning capacity and sustained disability and disfigurement, the suit states.
Wendy's negligently failed to maintain the parking lot, failed to properly inspect the parking lot, failed to maintain the property so as not to have obstructions and improperly designed the parking lot and drive thru lane, the complaint says.
In her four-count complaint, Crunk is seeking a judgment of more than $200,000, plus costs and other relief the court deems just.
Andrew G. Toennies of Lashly and Baer in St. Louis and Thomas G. Kemper of Butler and Kemper in Granite City will be representing her.
St. Clair County Circuit Court case number: 12-L-120.
