Father seeks to enforce $100,000 settlement over daughter's ATV death

The father of a recently deceased girl claims his daughter died during an ATV accident.

Larry Garner filed a motion to approve settlement of wrongful death claim on March 2 in Madison County Circuit Court.

In his complaint, Garner alleges his minor daughter, Montana Garner, died during an ATV accident on March 13, 2010. Since the incident, negotiations have been under way, and the parties involved have reached a settlement in which the unspecified ATV manufacturer agreed to pay Garner $100,000 for his daughter's death.

"Larry Garner states to this Court that he believes the foregoing offer of settlement to be fair and equitable, considering the nature and extent of the injuries sustained by the minor child, and believes it to be in the best interests of the Estate of Montana Garner to settle and compromise all claims in accordance with the current gross settlement amount," the motion states.

In his motion, Larry Garner is asking the court to approve his settlement and seeks other relief the court deems just.

Ely Hadowsky of Brown and Brown in St. Louis will be representing him.
