Shelbyville couple sues over Route 157 accident

A Shelbyville couple claims they sustained various injuries after a driver rear-ended their vehicle.

Christopher and Kimberly Binnion filed a lawsuit Feb. 24 in Madison County Circuit Court against Louis J. Browning.

In the complaint, the Binnions claim Kimberly Binnion drove her 1999 Chevy Chrysler south on Illinois State Route 157 on March 21 when she reduced her speed to make a right-hand turn into a driveway. Suddenly, Browning, who drove a 2006 Nissan Titan behind the Chrysler, rear-ended the Binnions' vehicle, according to the complaint. At the time of the collision, Christopher Binnion was riding in the vehicle with Kimberly Binnion.

Because of the accident, Christopher Binnion sustained head injuries while Kimberly Binnion sustained neck and back injuries, the suit states. In addition, they both incurred permanent disability and experienced great pain and suffering, the complaint says.

The Binnions blame Browning for causing the collision, saying he negligently failed to drive in a safe manner, failed to reduce his speed to avoid a collision, failed to keep a proper lookout and failed to yield the right-of-way.

In their two-count complaint, the Binnions seek a judgment of more than $100,000, plus medical costs.
