Collinsville Ice and Fuel sued over collision

A man claims he experienced pain and suffering after a driver failed to keep a proper lookout and struck his vehicle.

Dana Martin filed a lawsuit Feb. 1 in Madison County Circuit Court against Collinsville Ice and Fuel Company and Wesley Langston.

In his complaint, Martin claims he drove on State Route 143 near Cally Lane in Highland on Oct. 18, 2010, when Langston, who was driving for Collinsville Ice and Fuel, struck his vehicle.

Martin does not specify how the collision occurred, but does say Langston negligently failed to keep a proper lookout, failed to keep his vehicle under proper control, failed to reduce his speed to avoid a collision and followed Martin's vehicle too closely, according to the complaint.

Because of the collision, Martin experienced pain, suffering, disability and disfigurement; incurred medical costs; and lost his income and his normal life, the suit states. Martin also incurred property damages, the complaint says.

In his two-count complaint, Martin is seeking a judgment of more than $100,000, plus costs.
