Route 159 accident is subject of St. Clair County suit

A woman has filed suit against the driver who she claims failed to maintain a proper lookout and struck her vehicle.

Cynthia L. Schwinn claims she was driving south on Illinois State Route 159 near Robinson School Road in Smithton on May 15, 2010, when defendant Clayton D. Groom, who was driving on the same road, struck her vehicle.

Because of the collision, Schwinn suffered pain and incurred medical costs, according to the complaint filed Jan. 20 in St. Clair County Circuit Court.

Schwinn blames Groom for causing the collision, saying he negligently failed to keep a proper lookout, drove too fast, drove without adequate brakes and failed to yield the right-of-way, among other negligent acts.

In her complaint, Schwinn is seeking a judgment of more than $50,000, plus costs.

She will be represented by Chris Kolker of Kolker Law Offices in Belleville.

St. Clair County Circuit Court case number: 12-L-40.
