O'Fallon Dairy Queen sued over customer's slip on wet floor

A St. Clair County man is suing the owners of an O'Fallon Dairy Queen after he allegedly slipped on a wet floor.

Bryan Schmittling filed the lawsuit Jan. 19 in St. Clair County Circuit Court against CMRM LLC, doing business as O'Fallon Dairy Queen, and Ronald Moss.

Schmittling says he was at the Dairy Queen on West Highway 50 to eat in January 2010. As he walked across the restaurant, Schmittling claims he slipped on a wet area of the floor and fell. The man says he was seriously injured in the fall.

Schmittling accuses the restaurant and its owner, McDonald, of negligence and asks for more than $100,000 in damages for medical bills, lost wages and court fees.

Attorney Ronald J. Foster of East St. Louis is representing Schmittling.
