Insurer sues driver over insured's collision repairs

An insurance company has filed suit against the driver who it claims struck a vehicle it had insured, causing it to incur costs of more than $60,000.

State Farm Mutual Automobile Insurance Company claims it had to pay $13,501.48 to repair a 2007 Jeep Carryall vehicle that was damaged in a car collision on Feb. 3, 2010.

The collision occurred when defendants Truley U. Roberson, Xan K. Hacker and Brandon Schantz struck the Jeep as it was traveling at the intersection of Carlyle Avenue and Back Drive in St. Clair County, according to the complaint filed Jan. 18 in St. Clair County Circuit Court.

In addition to the repair costs State Farm incurred, it also had to pay more than $55,000 for medical costs associated with the collision, the suit states.

The defendants negligently followed another vehicle too closely, failed to yield, improperly used the lanes of the road, failed to keep a proper lookout and failed to reduce their speeds to avoid a collision, the complaint says.

In addition to the money it says it paid out, State Farm is seeking costs and other relief the court deems just.
