Lopinot to hold hearing in lawsuit against parking lot owners and designers

St. Clair County Associate Judge Vincent Lopinot will hear a motion to compel on Feb. 14 in a case of a woman who filed suit against the owners of a Belleville building where she claims she fell in a parking lot.

Pamela S. Kronenberger claims she was crossing a parking lot at the Dollar Tree in Belleville Crossing on April 3, 2010, when she fell due to a parking lot hazard, according to the complaint filed Oct. 31.

In her complaint, Kronenberger names Impact Strategies, The Hinrichs Group, SM Properties 2000, TDG Belleville Crossing, The Desco Group and Nova Group as defendants.

The attorney for Impact Strategies and The Hinrichs Group sent Kronenberger's lawyer a letter requesting discovery compliance and inviting counsel for Kronenberger to engage in personal consultation to resolve differences.

The motion to compel filed Jan. 23 said the plaintiff still has yet to comply with Impact Strategies' and The Hinrichs Group's discovery requests.

Due to her fall, Kronenberger's alleges right shoulder was injured. She also claims to have suffered pain and mental anguish. In addition, she lost money because of her inability to pursue her normal occupation, and incurred medical costs, the complaint says.

Kronenberger blames the owners, designers and constructors of the building for causing her fall, saying they failed to maintain the building's parking lot, failed to warn her of the dangerous condition and failed to remedy the dangerous condition.

She is seeking a judgment of more than $50,000, plus costs.

She is represented by Gregory M. Skinner and Joseph A. Bartholomew, both of Belleville.

Defendants TDG Belleville Crossing, The Desco Group and SM Properties say that Kronenberger failed to exercise care for her own safety, failed to keep a careful lookout and failed to observe an open and obvious condition.

William Knapp represents Impact Strategies and The Hinrichs Group.

Joseph Callahan represents SM Properties and TDG Belleville Crossing and The Desco Group.
