Baer Road accident is subject of suit

Richards

A woman has filed suit against the driver who she claims failed to yield the right-of-way and struck her vehicle.

Michelle Boisseau claims she was driving south on Baldwin Road approaching its intersection with Baer Road in St. Clair County on July 15, 2010, when defendant Alan Schaeffer, who was driving east on Baer Road, failed to yield the right-of-way at the intersection and collided with her vehicle. At the time of the collision, Michelle Boisseau's daughter, Haley Boisseau, was riding in the vehicle with her, according to the complaint filed Jan. 11 in St. Clair County Circuit Court.

Because of the collision, both Michelle Boisseau and her daughter sustained severe and permanent injuries and incurred medical costs. In addition, they lost their earning capacities, lost their normal lives and experienced physical pain and suffering, the suit states.

Schaeffer negligently failed to keep a proper lookout, failed to obey a traffic sign, failed to avoid a collision, failed to warn of an impending collision and failed to yield the right-of-way, the complaint says.

In her complaint, Boisseau is seeking a judgment of more than $150,000, plus costs and other relief the court deems just.

Timothy S. Richards of Neville, Richards and Wuller in Belleville will be representing her.

St. Clair County Circuit Court case number: 12-L-18.
