Ruth resets hearing in woman's claim that a couple's dog bit her daughter

Madison County Circuit Judge Dennis Ruth has reset summary judgment arguments involving a personal injury suit over a dog attack.

Tammy Wall, the mother minor Lilly M. Wall, is suing Kristine Walker, Luther F. Walker and Judith A. Walker, claiming Lilly Wall walked past 825 Hawthorne Ave. in Wood River on Sept. 2, 2008, when the Walkers' dog attacked her.

The girl suffered scarring and disfigurement and experienced great pain and anguish, according to the complaint.

In the defendants' motion for summary judgment, the Walkers argue that the plaintiff brought an action against them based on a violation of the Animal Control Act.

According to the Walkers' attorney, Michael Bedesky, the Walkers did not own the dog pursuant to the Animal Control Act, and they are entitled to a judgment in their favor.

On Jan. 20, Ruth reset the case for argument to Jan. 31.
