Casino Queen answers slip and fall complaint

A St. Clair County casino is fighting back in a lawsuit filed against it by a woman who says she slipped on a wet restroom floor.

LV Shamburger filed the lawsuit against Casino Queen Inc. on Dec. 8 in St. Clair County Circuit Court.

The Casino Queen, represented by Belleville attorney Michael J. Nester, on Jan. 9 answered the complaint saying Shamburger's injuries were the result of her own negligence.

Shamburger says the fall happened in one of the casino's restrooms in July. She says a plumbing problem caused water to collect on the floor in one of the bathroom stalls. Shamburger says she didn't see the water and slipped.

The alleged incident caused serious injuries that required extensive medical care, including surgery and hospitalization, she claims.

Shamburger says the casino has a responsibility to keep the restrooms in working order to avoid creating a dangerous situation for patrons.

She is asking for more than $50,000 in damages for medical bills and court costs.

Attorneys Thomas E. Schwartz and Justin D. Guerra of St. Louis are representing Shamburger.
