Edwardsville Moto Mart sued by customer over icy walkway

A Madison County man is suing the owners and operators of an Edwardsville convenience store, claiming he slipped and fell on an icy walkway.

Anthony Fazio filed the lawsuit Dec. 23 in Madison County Circuit Court against Moto Inc. and FKG Oil Company.

According to the complaint, Moto Inc. leased a Moto Mart store on North Main Street to FKG Oil. In February 2010, Fazio says he was walking to the store's front door when he allegedly slipped on some ice that had formed on the sidewalk.

Fazio claims the Moto Mart's gutters were poorly maintained which allowed snow and ice melt to drain over them and onto the walkways that led to the store.

Fazio accuses the owners of the property, Moto Inc., and the operators of the store, FKG Oil, of negligence for not cleaning the gutters or the sidewalk. He alleges they are responsible for the injuries he received when he fell. Fazio is asking for more than $250,000 in damages for medical bills and court fees.

Fazio is represented by attorney Michael P. Glisson of Alton.
