A man has filed suit against the driver who he claims rear-ended his vehicle.
David L. Hicks claims he was driving 2000 Ford ZX3 north on Highway 157 at its intersection with Game Drive, waiting to make a left-hand turn, on Jan. 10, 2010, when defendant John Runde, who was driving a 2004 Buick Century in the same direction, rear-ended his vehicle.
Because of the collision, Hicks sustained injuries to his neck, shoulder and back; experienced extreme pain and suffering; and incurred medical costs of more than $27,000, according to the complaint filed Dec. 19 in Madison County Circuit Court. He also lost his ability to enjoy his normal pursuits of life, the suit states.
Runde negligently failed to keep a proper lookout, failed to brake to avoid a collision and failed to maintain a safe distance between his vehicle and Hicks's.
In his complaint, Hicks is seeking a judgment of more than $50,000, plus costs and other relief the court deems just.
He will be represented by Joseph R. Dulle of Stone, Leyton and Gershman in St. Louis.
