Handyman sues home owner after garage door falls on head and back

A man has filed suit against the owner of a Belleville property after he claims a garage door at the property unexpectedly fell on him.

Howard Mister claims he was working as a handyman at defendant William Bach's home at 1202 Cart Lane in Belleville on Dec. 22, 2009, when the door fell on his head and back.

Because of the incident, Mister suffered severe and permanent injuries and experienced physical and mental pain and anguish, according to the complaint filed Dec. 15 in St. Clair County Circuit Court. He also incurred medical costs and suffered from a damaged earning capacity, the suit states.

Bach negligently failed to keep the premises in a safe condition, failed to warn Mister of the dangerous condition and failed to inspect the premises, the complaint says.

In his complaint, Mister is seeking a judgment of more than $50,000, plus costs.

He will be represented by Jeanne L. AuBuchon in Belleville.
