TJ Maxx sued by shopper over water on floor

A Belleville woman has filed suit against TJ Maxx after she claims she slipped and fell on water in the store.

Pamela Dauphin claims she was shopping at the Fairview Heights TJ Maxx on Dec. 24, 2009, when she slipped on water on the store's floor.

Because of her fall, Dauphin sustained severe injuries to her knees, legs, ankles and feet and was hindered and prevented from attending to her usual affairs, according to the complaint filed Dec. 14 in St. Clair County Circuit Court. In addition, she lost wages; experienced pain, suffering and anguish; incurred medical costs; suffered disability and disfigurement; and lost her normal life, the suit states.

TJ Maxx employees negligently allowed water to remain on the store's floors, failed to properly clean up the water, failed to provide a safe place for Dauphin to walk and failed to provide a safe entrance and exit, the complaint says.

In her complaint, Dauphin is seeking a judgment of more than $50,000, plus costs.

She will be represented by Scott Hassebrock of Mascoutah.
