Baxmeyer Construction denies it is responsible for Fredman Brothers' water-damaged furniture

Baxmeyer Construction Co. responded to a lawsuit filed by Fredman Brothers Furniture Co., denying it is responsible for furniture damaged by leaking water.

Fredman Brothers claims furniture was destroyed after Baxmeyer was involved with road construction excavation on Illinois Route 159 and Main Street in Collinsville earlier this year. The plaintiff claims water was allowed to leak and destroy furniture stored in a lower level of its building.

In its answer to the Nov. 3 complaint filed in Madison County, Baxmeyer also demands a trial by jury.

Baxmeyer Construction certified on Dec. 15 that its questions and requests for documents were sent to Fredman Brothers.

In their complaint, Fredman and Home Furniture seek a judgment of more than $50,000, plus costs.

Harry J. Sterling of Sterling and Dowling in Fairview Heights represent Fredman Brothers Furniture Company.

Seth G. Gausnell of Pitzer Snodgrass is representing Fredman Brothers.

Madison County Circuit Judge Dennis Ruth is assigned to the case.
