Cook County residents sue Allstate in Madison County

Two Cook County residents have filed suit against their insurance company, alleging it refused to pay them for damages caused to their home after vandals broke into it.

Linda S. Besci and Frank J. Besci of Barrington claim they were out of town on Sept. 13, 2010, when unknown vandals broke into their home at 110 Weatherstone Rd., causing severe damage to it.

Following the break-in, the Bescis contacted defendant Allstate Insurance Company and asked it to reimburse them for the more than $230,000 in damages caused to their property, according to the complaint filed Dec. 12 in Madison County Circuit Court.

Allstate refused to pay the damages, accusing the Bescis of committing fraud, of false swearing and of material misrepresentations, the suit states.

The Bescis, however, contend they committed no wrongdoing, the complaint says.

Because Allstate refused to reimburse the Bescis, they claim they have been unable to use their property and incurred economic damages.

In their two-count complaint, the Bescis seek a judgment of more than $300,000, plus attorneys' fees, costs and other relief the court deems just.
