Avalon driver claims Silhouette driver rear-ended him

A man has filed suit against the driver who he claims rear-ended his vehicle as he waited at a red light.

John D. Moutria claims he was driving a 1997 Toyota Avalon west on St. Louis Road at its intersection with Collinsville Road in Collinsville on Dec. 17, 2009, when he stopped at a red light. Suddenly, defendant Jonathan L. Brown, who was driving a 1990 Oldsmobile Silhouette in the same direction, failed to stop and struck the back of Moutria's vehicle, according to the complaint filed Dec. 12 in Madison County Circuit Court.

Because of the collision, Moutria suffered severe and permanent injuries to his back, neck, legs, shoulders, hands, mouth and teeth and suffered extreme pain, the suit states. He also lost large sums of money, incurred medical costs for dental implants and steroid injections and lost his enjoyment of life, the complaint says.

Moutria blames Brown for causing the collision, saying he negligently failed to keep his vehicle under control, failed to keep a proper lookout, failed to obey a traffic-control device and failed to reduce his speed to avoid a collision. In addition, Brown negligently failed to stop when approaching an intersection and drove while attempting to adjust an item on his dashboard, according to the complaint.

In his complaint, Moutria is seeking a judgment of more than $50,000.
