A furniture company claims its furniture was destroyed after a construction company performed excavation work that allowed water to leak into a level in which the furniture was stored.
Fredman Brothers Furniture Company and Home Furniture filed a lawsuit Nov. 3 in Madison County Circuit Court against Baxmeyer Construction Company.
In its complaint, Fredman Brothers Furniture Company and Home Furniture claim Baxmeyer performed excavation road construction work on Illinois Route 159 and Main Street in Collinsville at some point before March 3.
In turn, the work caused damages to Fredman's premises at 128 East Main St. in Collinsville by allowing water to leak into the building's lower level, according to the complaint. The water damaged furniture owned by Home Furniture, which was stored in the lower level, the suit states.
"The rains continued for several days, compounding the damage to the furniture," the complaint says.
In their complaint, Fredman and Home seek a judgment of more than $100,000, plus costs.
Harry J. Sterling of Sterling and Dowling in Fairview Heights will be representing them.
Madison County Circuit Court case number: 11-L-1152.
