Broyhill claims O'Fallon tenant has failed to pay rent

Broyhill has filed suit against one of its O'Fallon tenants, alleging the tenant has failed to pay rent since September.

Broyhill Retail claims it subleased premises at 1246 Central Park Drive in O'Fallon to defendant KBL America beginning on Aug. 31, 2009.

As part of the lease agreement, KBL promised to pay rent of $15,000 per month, according to the complaint filed Oct. 14 in St. Clair County Circuit Court. Beginning in October 2012 through September 2013, KBL agreed to allow Broyhill to increase the rent to $16,000 per month and to $17,000 each month beginning in October 2013 through the end of the lease in November 2015, the suit states.

However, in September, KBL ceased making its minimum monthly rental payments, the complaint says.

"As of the filing of this complaint, the total amount due by Tenant to Broyhill for unpaid rent is at least $30,000 with rent continuing to accrue per the terms of the Sublease," the suit states.

In addition to the money it says it is owed, Broyhill is seeking pre-judgment interest, attorney's fees and other relief the court deems just.
