A St. Clair County man claims a restaurant vacated its leased premises early, violating its contract with the man and owing the man more than $60,000.
Dong Ha Kim filed a lawsuit Oct. 19 in St. Clair County Circuit Court against Bhaskar Brahmbhatt and Badetoom Restaurant Group.
In his complaint, Kim alleges Badetoom agreed to rent his premises at 747 Siebert Rd. near Scott Air Force Base beginning on May 24.
However, by August, Badetoom had abandoned the premises, breaching its contract, which was set to expire on May 25, 2014, according to the complaint.
"Defendants are in breach of their rental obligations and are in arrears in the amount of $5,683.33 as and for rent and late charges through Oct. 5, 2011; missing equipment in the amount of $1,500; lease charges owned through the expiration of the Lease in the sum of $61,100; leaving the balance currently due and owing to Plaintiff the amount of $68,283.33 for rent and other charges through the expiration date of the Lease," the suit states.
In addition to the money he says the defendants owe him, Kim seeks attorney's fees, costs and other relief the court deems just.
