A woman claims she sustained wrist injuries after falling on liquid in a Kmart aisle.
Brenda Smith filed a lawsuit Oct. 14 in Madison County Circuit Court against Kmart Stores of Illinois.
In her complaint, Smith alleges she was walking near the checkout lane when she encountered a spilled dark liquid on the floor and fell.
Because of her fall, Smith sustained left carpal tunnel syndrome, sustained great physical pain and mental anguish and incurred medical costs, according to the complaint. In addition, she lost wages, endured disability, lost her normal life and suffered disfigurement, the suit states.
Smith alleges Kmart negligently failed to properly maintain its walkways, failed to routinely inspect its walkways, caused a spill and allowed the liquid to remain on the floor, failed to warn Smith of the spilled liquid, failed to place a warning sign near the spill and failed to keep its walkway slip resistant, the complaint says.
Smith is seeking a judgment of more than $50,000, plus costs.
