East St. Louis property owners say State Farm failed to pay fire claim

An East St. Louis homeowner accuses its insurance carrier of not paying on a policy claim after the home was damaged in a fire.

L.V. Thomas & Jim Hayes Properties Inc. filed a lawsuit July 15 in St. Clair County Circuit Court against State Farm Fire and Casualty Company.

According to the complaint, Thomas & Hayes own a home on Belleview Avenue. The company allegedly had the house insured with State Farm under a policy issued in June 2009. Two months later, the rental home was allegedly damaged by fire and has remained vacant since.

Thomas & Hayes allege it was given an initial payment from State Farm of $1,550 for lost rent in October 2009 but have yet to be paid in full for the claim.

Thomas & Hayes are suing State Farm for denying coverage, a violation of Ilinois' Insurance Code, and ask to be paid more than $50,000 in damages.

The property company is represented by attorneys Ryan J. Mahoney and David L. Antognoli of Edwardsville.

St. Clair County Circuit Court case no. 11-L-403.
