A woman has filed suit against the driver who she claims ran into her vehicle.
Mary M. Wohlgemuth claims she was driving east on I-64 at mile post 3 in the left-hand lane at about 8 p.m. on July 23, 2009. At the same time, defendant Amanda Schmitt was driving in the right-hand lane and attempted to switch into the left-hand lane when she struck Wohlgemuth's vehicle, according to the complaint filed July 21 in St. Clair County Circuit Court.
Because of the collision, Wohlgemuth sustained neck and back injuries, incurred medical costs and experienced pain, suffering and discomfort, the suit states.
Schmitt negligently failed to keep a proper lookout, failed to drive within a single lane, drove too fast, failed to yield the right-of-way and failed to keep her vehicle under control, the complaint says.
In her suit, Wohlgemuth is seeking a judgment of more than $50,000, plus costs.
