The two administrators of a deceased man's estate blame employees at an Edwardsville nursing home for causing the man's death, saying they failed to provide adequate care for the man, who died of a subdural hematoma.
Samuel Wood and Michelle Walton filed a lawsuit Aug. 9 in Madison County Circuit Court against Edwardsville Health Care Center Investors doing business as University Nursing and Rehabilitation Center and its owners -- Jerry Neal, John Davis and Mark Ride.
In their complaint, Samuel Wood and Walton allege Robert W. Wood Jr. was living at the University Nursing and Rehabilitation Center on June 14 when he died after blood rapidly collected in his brain, an occurrence known as a subdural hematoma.
Before his death, Robert W. Wood Jr. experienced severe pain, emotional distress and mental anguish and lost his dignity, according to the complaint. In addition, he became further debilitated and disabled between June 11 and his death on June 14 and incurred substantial medical costs, the suit states.
The plaintiffs blame the nursing and rehabilitation center and its owners for causing Robert Wood Jr.'s death, saying they negligently failed to provide Robert Wood Jr. with adequate care, failed to protect him from neglect and failed to provide necessary treatment and services to provide Robert W. Wood with the highest level of functioning, among other negligent acts.
In their eight-count complaint, Samuel Wood and Walton seek a judgment of more than $400,000, plus attorneys' fees and costs.
Gregory L. Shevlin of Cook, Ysursa, Bartholomew, Brauer and Shevlin in Belleville will be representing them.
