Driver accused of crossing center lane in Worden accident

A collision caused two people to become sick, sore, lame and disordered, according to recently filed court documents.

Cassandra and Bryan Cusimano filed a lawsuit July 22 in Madison County Circuit Court against Broderick Bevineau.

The Cusimanos claim Cassandra Cusimano drove north on Church Road at its intersection with Schien Road in Worden on Nov. 1, 2009, when Bevineau, who drove south on the same road, lost control of his vehicle and swerved into her lane.

"Cassandra Cusimano attempted to go to the east side of the road but was stopped by the embankment and unable to avoid striking Broderick Bevineau," the suit states.

At the time of the collision, Bryan Cusimano rode as a passenger in Cassandra Cusimano's vehicle, the complaint says.

Because of the collision, the Cusimanos claim they lost their earning capacities, experienced pain and suffering, incurred medical costs and suffered disability and disfigurement.

They blame Bevineau for causing the collision, saying he negligently failed to keep a proper lookout, failed to brake to avoid a collision, failed to keep his vehicle under proper control and failed to yield to oncoming traffic, according to the complaint.

In their complaint, the Cusimanos seek a judgment of more than $50,000, plus costs and other relief the court deems just.
