Venice driver claims he was rear-ended

A man has filed suit against the driver who he claims rear-ended his vehicle.

Jarrell R. Rogers claims he was driving east on Market Street in Venice on June 30, 2010, when defendant Robert L. Barth, who was driving on the same street, ran into the rear of his vehicle.

Because of the collision, Rogers suffered disability and disfigurement, lost earnings and suffered great pain and mental anguish, according to the complaint filed July 13 in Madison County Circuit Court. In addition, he incurred medical costs and suffered a diminished earning capacity, the suit states.

Barth negligently failed to keep a proper lookout, drove in such a manner as to strike the rear of Rogers's vehicle, failed to properly apply his brakes, failed to reduce his speed to avoid a collision and failed to yield to Rogers's vehicle, the complaint says.

In his complaint, Rogers is seeking a judgment of more than $50,000, plus costs and other relief the court deems just.
