A man and wife are suing a driver they say caused a serious crash in Godfrey.
Florenz Wernet and Theresa Wernet filed a complaint July 8 in Madison County Circuit Court against Denny A. Maggos.
Florenz Wernet says the alleged crash happened in September 2010 in Godfrey. Wernet says he was driving south of US Highway 67 near the intersection with Northport Street.
As Wernot drove through the intersection, he says Maggos, who driving in the opposite direction, allegedly turned in front of him, causing the two vehicles to crash. Wernot and his wife, Theresa, who was a passenger in his car, say they received "serious and disabling injuries" to their body, arms and legs. The injuries allegedly required surgery and hospitalization.
The Wernots contend the defendant caused the crash by failing to drive at a safe speed, failing to keep a proper lookout and failing to take actions necessary to avoid the collision. The Wernots say that makes Maggos liable for the crash.
The couple is asking Maggos to pay more than $50,000 in damages for injuries, medical care, pain and suffering, emotional distress, lost pages and the inability to carry out usual activities.
