Car accident suit set for trial Monday settles

A Granite City accident case filed last year that was set for trial today has settled.

Madison County Circuit Judge Andreas Matoesian had been set to open the suit's trial at 9 a.m.

Plaintiff Justin McElroy filed a motion July 14 asking the court to continue the July 18 trial due to a settlement with defendant Elvis Flowers.

Details of the settlement are not yet available in the case file.

The plaintiff is waiting on the settlement release and draft, according to his motion.

McElroy's suit sought damages in excess of $50,000 and other relief.

The plaintiff claims he suffered severe back and spinal injuries when Flowers' car collided with him after the plaintiff alleges Flowers failed to yield and failed to stop at an intersection.

Monday's trial would have begun at 9 a.m.

Ronald Motil represents the plaintiff.

The case is Madison case number 10-L-020.
