Godfrey woman claims driver slammed into side of car

A Godfrey woman has filed suit against the driver who she claims slammed into the side of her vehicle as she attempted to cross an intersection.

Cathy J. Mouser claims she was driving a 2007 Honda Civic south on Alby Street at its intersection with East/West Center Street in Alton on Aug. 19 when defendant Lena M. Story drove her vehicle into the side of Mouser's Civic.

Because of the collision, Mouser sustained temporary and permanent injuries and incurred medical costs, according to the complaint filed June 28 in Madison County Circuit Court. In addition, she was prevented from attending to her usual duties and affairs, the suit states.

Story negligently failed to keep a proper lookout, drove too fast, failed to exercise proper control over her vehicle, failed to brake and failed to yield the right-of-way, the complaint says.

In her lawsuit, Mouser is seeking a judgment of more than $50,000, plus costs.

Lanny Darr of Schrempf, Kelly, Napp and Darr in Alton will be representing her.

Madison County Circuit Court case number: 11-L-630.
