A move to take a legal malpractice case filed by a break-away Roman Catholic church against its former attorneys to a Missouri court is set for hearing next week before a St. Clair County judge.
St. Clair County Lloyd Cueto is set to preside at the hearing on a motion to transfer filed by the law firm of Greensfelder, Hemker & Gale P.C.
The hearing is set for 9 a.m.
Plaintiff Polish-Roman Catholic St. Stanislaus Corporation is suing the firm alleging that one of it attorneys used information gleaned from years of representing the plaintiff against the church when his firm in turn represented the Archdiocese of Saint Louis in matters concerning St. Stanislaus.
The archdiocese has been attempting to regain control of St. Stanislaus, a former parish located in north St. Louis city.
The dispute over the control of the church and its property has escalated into a lawsuit that pits the archdiocese against St. Stanislaus in Missouri court.
St. Stanislaus filed suit against the Greensfelder firm last year in St. Clair County alleging legal malpractice and that the firm breached the bounds of ethics when it began representing the archdiocese in the Missouri suit.
Greensfelder moved last year to take the legal malpractice suit to Missouri based on forum non conveniens.
Greensfelder alleges that aside from one of the firm's satellite offices in Swansea, the St. Stanislaus suit lacks any connection to St. Clair County.
Thomas Keefe Jr. represents the church.
Michael Nester represents the law firm.
