Injuries claimed in East Roosevelt Road accident

A Madison County woman claims she experienced pain and suffering after a driver attempted to pass her, causing a collision.

Susan Marin filed a lawsuit June 22 in Madison County Circuit Court against Arron Ellerbeck.

In her complaint, Marin claims she drove east on Roosevelt on Jan. 27, 2010, at about 8:29 p.m. and was waiting to turn left onto West Drive when Ellerbeck, who was driving behind her, attempted to pass her on the left. A collision ensued, according to the complaint.

Because of the collision, Marin suffered physical and emotional injuries resulting in pain, suffering and disability and sustained neck and left shoulder injuries, the suit states. In addition, she incurred medical costs and lost her enjoyment of life, the complaint says.

Marin blames Ellerbeck for causing the collision, saying he negligently failed to drive at a safe speed, failed to drive on the right side of the road, drove without keeping a proper lookout, failed to keep his vehicle in the correct lane, failed to use ordinary care in driving his vehicle, attempted to pass another vehicle when it could not safely be done and followed Marin's vehicle too closely. In addition, Ellerbeck negligently made an improper left turn and improperly attempted to pass while making a left turn, according to the complaint.

In her complaint, Marin seeks a judgment in excess of the minimum jurisdictional limits of Madison County Circuit Court, plus costs and other relief the court deems just.
