Case over flooded Collinsville home set for case management conference Wednesday

A couple's suit over a property they found to be prone to flooding after they purchased it is set for case management Wednesday.

Madison County Circuit Judge William Mudge will take up the case along with his usual case management docket beginning at 9 a.m.

Plaintiffs Donald and Vickie Wilson are suing Donald and Peggy Shank and Terry Allan, the owner of Allan Auction Service for damages in excess of $60,000 and other relief.

The Wilsons allege that they were deceived and not informed about water damages and flood risks at a property they purchased from the Shanks via auction in Collinsville.

The Wilsons allege that they have lost out on substantial rent moneys due to the alleged deception.

The defendants have moved to dismiss the suit citing documents that show the Wilsons bought the property "as is."

The parties continued a May 23 trial in the case.

Alicia Downs represents the plaintiffs.

William Berry represents the Shanks.

H. Carl Runge represents Allan.

The case is Madison case number 10-L-033.
