Pizza delivery driver was drunk, suit against Domino's claims

A Granite City man says his back was broken when a pizza delivery man crashed into him while allegedly driving drunk.

Scott D. Price filed a lawsuit May 18 in St. Clair County Circuit Court against Jemontae L. Tomlinson, Dennis R. Loos and Domino's Pizza- Scott Air Force Base.

According to the complaint, Price was driving north on Illinois Route 3 in May 2009, just south of the Poplar Street Bridge, when Tomlinson allegedly crashed into him. Price says Tomlinson was driving a car owned by Loos and Domino's Pizza. Price claims Tomlinson was arrested shortly after the crash and convicted for driving under the influence of alcohol.

Price accuses Tomlinson, Loos and Domino's of negligence and asks for more than $150,000 in damages for medical bills, lost wages and court costs.

Price is represented by attorney Justin M. Whitton of Belleville. They ask for a jury trial.
