Madison County Chief Judge Ann Callis has approved the settlement of a man's suit against the owners of a Granite City trailer park where he claims he was attacked and beaten by the park's residents.
Plaintiff John Hartline settled with Edwards Associates LLC, the owners of the Route 66 Mobile Home Park in April and Callis approved the settlement June 13.
The amount of the settlement is not included in the June 13 order or stipulation of dismissal filed by the parties.
The settlement does not cover two amended defendants added to the case in 2009.
Those defendants, Jesse Gibson and Darla Martin, have not yet entered appearances or filed pleadings in the case to date.
Hartline sought damages in excess of $150,000 and other relief.
According to his Sept. 30, 2009 first amended complaint, Hartline was at the Route 66 trailer park on Aug. 25, 2007 in order to perform maintenance work.
While on site, the plaintiff alleges that he was attacked and beaten without cause.
He claims that Edwards Associates had a duty to protect him from the assault and that the
defendant did not intervene in the attack, did not contact the police in a timely manner, did not take reasonable actions against resident misconduct, and allowed people to live in the mobile home park who exhibited dangerous and hostile behavior.
Hartline alleges that Gibson punched him, attacked him with wooden boards and a metal pipe and threw things at him.
The plaintiff contends that Martin attacked him in a similar manner.
The case was previously assigned to former Madison County Circuit Judge Daniel Stack.
