A Madison County man claims he sustained injuries to his right arm and back after falling on a puddle of water that had spilled from an air conditioner.
Mark Leady filed a lawsuit June 7 in Madison County District Court against Steak N Shake Operations.
Leady claims he visited Steak N Shake on July 31, 2010, at about 4 p.m. when he fell in a large puddle of standing water near an overhead air conditioning unit.
In addition to his injuries, Leady suffered pain of his body and mind, incurred medical costs and lost money, according to the complaint.
Leady blames Steak N Shake for causing his injuries, saying it failed to warn customers of standing water, allowed a puddle of water to stand in an area where it knew customers would walk and failed to barricade the puddle. In addition, the restaurant failed to clean up the puddle, the suit states.
In his complaint, Leady seeks a judgment of more than $50,000, plus costs.
