Madison County man sues ophthalmologist

A Madison County man claims his doctor failed to accurately diagnose his eye condition, causing him to seek corrective care from a different provider.

Andrew Merkle filed a lawsuit June 9 in Madison County Circuit Court against Riverbend Ophthalmologists and Dr. James Hudson.

In his complaint, Merkle claims he remained a patient of Hudson's from April 26, 2007, through June 12, 2009. During that time, Hudson failed to accurately diagnose Merkle with an eye condition, according to the complaint. In his suit, Merkle never specifies which eye condition he suffers from.

Because of Hudson's failure to diagnose, Merkle experienced pain and suffering and incurred additional medical costs, the suit states. In addition, Merkle missed work and lost wages and suffered permanent disability, the complaint says.

In his complaint, Merkle blames Hudson for his injuries, saying the doctor negligently failed to properly diagnose Merkle's condition, failed to properly examine Merkle's eye, failed to properly monitor Merkle's condition and failed to properly treat Merkle's condition.

In his two-count lawsuit, Merkle seeks an unspecified judgment, plus costs and other relief the court deems just.
