Defendant moves to set aside St. Clair County board member's default judgment

The defendant in a personal injury suit brought by St. Clair County Board Member Kenneth Sharkey is asking that a default judgment entered against her in April be set aside.

Defendant Elaine Schuessler filed her motion to set aside the April 8 default judgment May 11.

The amount of damages won in the default judgment has not been entered.

Sharkey sued Schuessler last year seeking damages for injuries he claims to have suffered in a Shiloh car accident.

Sharkey alleges that Schuessler crossed the center lane and hit him.

Schuessler claims in her May 11 filing that her insurance company was not notified of the suit until it received notice of the default judgment April 28.

David Simkins also entered his appearance for Schuessler on May 11.

Thomas Keefe Jr. represents Sharkey.

St. Clair County Associate Judge Andrew Gleeson presides.

The case is St. Clair case number 10-L-528.
