Accident case set for trial Monday settles

A suit over an Alton car accident that had been set for trial Monday has settled.

According to the case's docket sheet, attorneys informed Madison County Circuit Judge William Mudge of the settlement of the consolidated suit brought by plaintiffs Michael Rodriguez and Wanda Wilson June 9.

The settlement canceled the June 13 trial date that had been set in the case.

Rodriguez initially sued both Wilson and defendant Easter Battung in 2008 alleging that he was injured in a multi-car accident that occurred March 21, 2008 in Alton.

Rodriguez was a passenger in a car driven by Battung when it collided with Wilson's car.

Wilson went on to file her own complaint against Battung a year later.

The cases were joined last year.

Both plaintiffs sought damages in excess of $50,000 and other relief.

The details of the settlement of the suit were not available in the case file Friday.

Mudge took over the case from Madison County Circuit Judge Barbara Crowder when she took over the asbestos docket last year.

Brad Badgley represents Rodriguez.

Ana Maria Downs represents Battung.

Thomas Zimmer represents Wilson.

The case is Madison case number 08-L-367.
