The State of Illinois has filed a motion asking St. Clair County Circuit Judge Andrew Gleeson to compel a defendant to answer interrogatories in a case brought over injuries a Department of Natural Resources Officer suffered when an ATV drove into at Cahokia Mounds.
The May 2 motion marks the first action in the case since January.
The State of Illinois, through the Department of Central Management Services, is seeking to recoup workers' compensation payments it made after officer Timothy William Wichern was injured by two ATV riders in June 2008.
The state claims ATV driver Eric Robinson and passenger Megan Wieseman were illegally riding the ATV on part of the Cahokia Mounds Historic Site and failed to stop when Wichern directed them to before they crashed into him.
The state claims it has paid over $130,000 in benefits as a result.
The May 2 motion asks Gleeson to compel Robinson, of Collinsville, to answer interrogatories and requests for production.
Gleeson also entered an order the same day granting Wieseman of Mount Olive 28 days to answer the state's discovery requests.
Assistant State's Attorney Deborah Sterling Scott represents the state.
Terry Peebles represents Wieseman, according to Gleeson's May 2 order.
There is no attorney listed currently for Robinson. He has appeared on his own behalf at a prior hearing in the case.
The case is St. Clair case number 10-L-294.
