Hylla set to open trial against St. Anthony's Health Center Monday

Madison County Circuit Judge David Hylla is set to open the trial of a former rehabilitation patient's suit against St. Anthony's Health Center in Alton.

The trial in a case brought by plaintiff Darlene Westmoreland is set to begin at 9 a.m. on Monday.

Westmoreland initially filed suit against St. Anthony's and St. Clare's Hospital in 2009 seeking damages in excess of $50,000 per count and other relief.

Westmoreland alleges that during physical therapy exercises in May 2007, the defendants' staff members failed to properly monitor the therapy, did not hold her properly and allowed her to stand at a time when she should have been putting weight on her left leg due to surgery on her left knee.

As a result of the alleged negligence, the plaintiff claims she fell and suffered additional injuries including a torn left rotator cuff.

St. Anthony's denies the claims.

It is the only defendant left in the case.

Westmoreland moved to dismiss St. Claire's last month. Hylla granted the move April 12.

Thomas Kemper represents Westmoreland.

Edward Bott represents St. Anthony's.

The case is Madison case number 09-L-480.
