Madison County Circuit Judge Dennis Ruth continued a hearing set last week to May in a suit brought by a man who claims the Madison County Sheriff's Department denied him proper psychiatric care.
Madison County Sheriff Robert Hertz's office moved to dismiss the case brought by Hubert Hill earlier this year.
Ruth had been set to hear the motion April 21.
However, the judge continued the hearing in an order signed three days earlier.
Ruth is now set to hear the dismissal move May 20 at 10 a.m.
Hill is seeking damages for what he claims was the intentional withholding of psychiatric treatment.
Hill alleges that Dr. Robert Blankenship, also a defendant in the case, changed his prescriptions that kept his bi-polar disorder in check.
Hill alleges he then had episodes of hearing voices and seeing objects that weren't there.
He claims that Blankenship and Hertz violated his 14th Amendment rights.
The plaintiff seeks an order from the court forbidding Blankenship from practicing psychiatry without proper license, he asks for proper psychiatric treatment and more than $50,000.
The suit is the second pro se lawsuit Hill has filed in recent years.
In 2008, he sued his attorney, Morgan Scroggins, for allegedly refusing to speak to him or to form a defense.
The current case is Madison case number 11-L-027.
