Case management set in Bethalto homeowner's suit over storm flooding

A Bethalto man's suit against the village and a developer over sewer backups that allegedly flooded his home after storms in 2008 is set for case management.

Madison County Chief Judge Ann Callis will preside at the conference April 27 at 9 a.m.

Ron Hubler is suing the Village of Bethalto and R.L.P. Development Company, Inc. for negligence, nuisance and trespass counts.

The plaintiff seeks damages in excess of $50,000 per count and other relief.

According to his suit, Hubler's Bethalto home was flooded due to the back up of the village's sanitary sewers following storms in early 2008.

The village paid $19,000 to clean and repair the damage.

However, the plaintiff claims, sewers continued backing up throughout the year and the village failed to remedy the situation caused by its sewers.

He claims R.L.P. negligently developed and sold residential lots that were too low in elevation and therefore prone to flooding.

The defendant denies the claims.

The suit is one of several sparked by heavy storms in 2008 that caused flooding issues in several Metro East cities including Bethalto and Edwardsville.
