Mudge
A man's suit over the alleged amputation of his finger by a mechanical bull ride is set for a status update or dismissal.
Madison County Circuit Judge William Mudge signed an order Feb. 4 noting the case's lack of activity.
Plaintiff Timothy Cavins was last listed as representing himself in the matter against Fun Source Inc. and had moved for a default judgment against the company in May 2010.
The case management conference or dismissal hearing is set before Mudge Monday at 9 a.m.
Timothy Cavins alleges that Fun Source's mechanical bull was operated carelessly and that he was not given proper instruction in how to ride it at a picnic he attended in 2006.
Cavins' hand was injured while on the ride, he claims.
As a result, he lost a finger.
Fun Source had not entered an answer or other pleadings in the suit.
Morgan Scroggins previously represented Cavins but withdrew in March 2010.
The case was formerly assigned to Madison County Circuit Judge Barbara Crowder.
The case is Madison case number 08-L-792.
